The Choice of Brett Kavanaugh For Supreme Court Justice

The most critical choice being considered now is the appointment of Brett Kavanaugh to the Supreme Court of the United States. The media is spinning this as a right vs left, Democrat vs Republican, Trump supporter or anti-Trump vote. Nothing could be further from the truth. This is about putting a justice on the court who will interpret constitutional issues on the text within the context of intent, by the founding fathers.
Justice Kavanaugh is not a proponent of individual expectation to privacy. He interprets the constitution as written without regard for intent. This narrow view makes the Bill of Rights a restriction on our individual liberties not a minimum guarantee as intended. This is exactly why some of the Founders felt the Bill of Rights was not only unnecessary but dangerous as it could be used to constrain our rights to only these and the narrow definitions contained within.
Some of the founding fathers were insistent that the Bill of Rights was essential because they felt that these minimum guarantees were necessary to protect liberty. Yet now the text is used to limit what those liberties were defined as, not how it was intended. The Founders never would have expected that our reasonable right to privacy would be relinquished when travelling by normal conveyance for personal or business needs yet what rights do we relinquish through force of law when flying on an airplane?
This is a common mode of transportation yet we have given up our rights to privacy in our things and our person for the “convenience” of flying. Now we see the same things with our cell phone records including our calls and our location tracking data held for 5 years by the carrier. This information is given to 3rd parties, the cell phone tower owners to collect. The argument then is that we have voluntarily relinquished the information, it is their property a key distinction, so our expectation of privacy to be tracked is lost.
Justice Kavanaugh has written that the collection of our phone records can be used by the government in the name of national security. He doesn’t view privacy and its importance in the context of not only the Fourth Amendment, he ignores the Ninth and the Tenth. Our right to privacy is inalienable and absolute. The power to surveil our every word even in the supposed sanctity of our homes and means of conveyance, such as our cars is the epitome of tyranny and a means of control.
Our inalienable rights are not defined or confined to the words written in the individual amendments to the constitution. Nor are they defined through the rulings of the Supreme Court. The Supreme Court is a separate but equal branch of government and no more. The Constitution was written to ensure that the federal government was contained to its enumerated powers and no more. The Supreme Court through the power of judicial review has allowed the government to amass powers never intended and this has gone on for centuries.
Now technology will be introduced where everything in your home will be voice activated and listening all the time. Now the government can listen and watch us in the very sanctity of our homes. This is not liberty as the Founders intended to leave their posterity after fighting for their inalienable rights. Technology’s reach is expanding and it is being used against us by the globalists behind the deep state. We must realize that all powers not given to the federal government were retained by the States and the individual. The constitution through judicial review has weakened the binds of the constitution meant to constrain the federal government. States’ rights and individual rights are being trampled and this must end now.
Justice Kavanaugh on the grounds of constitutional interpretation has a record of being weak on protecting our individual rights to privacy. This is an issue of great importance now and even more in the not so distant future. We need a Supreme Court who will look at the constitution and especially our rights through the perspective of intent and context not strict interpretation of one part of the text. This narrow focus misses the point and endangers us all to tyranny and that was never the intent of the founders. We would do well to demand that our liberties be defended not undermined. In the case of our right to privacy. Brett Kavanaugh doesn’t seem to be in the best interests of the American people. I urge the Senate to quickly reject Brett Kavanaugh’s nomination and find a more suitable candidate.

The Supreme Court Decision on Cell Phone Tracking

The recent decision in Carpenter vs the United States by a 5-4 margin was a slim victory for privacy and liberty and by more than just the vote. The majority opinion written by Chief Justice Roberts was grounded in common sense but very limited in scope. He wrote that cell phones were virtually an indispensable way of life and some people are required by their occupation to carry them 24/7 and he’s right. He also noted that 5 years of historical data held by a third party couldn’t be gathered without a warrant because it had to meet the expectation of probable cause needed to search a person’s movement over that length of time without infringing on our reasonable expectation to privacy.
There were three dissenting opinions written in response with Justice Gorsuch writing his own opinion alone without concurrence. This is even more interesting in that Gorsuch wrote that had Carpenter argued that the cell-site location information records were his property he would have concurred with the majority. This simple distinction was pivotal in the decision-making process of all nine Supreme Court Justices. The key word here was property in the dissents written by Justice Kennedy with Justices Thomas and Alito as well as the other written by Justice Alito with Justice Thomas all hinged on the concept of ownership of the cell-site location information the expectation to privacy in the dissenting opinions were lost due to the issue that ownership of those records were held by the carriers of which AT&T was the largest.
Americans have by the nature of the internet and wi-fi essentially given away our reasonable right to privacy in order to avail ourselves of the convenience these innovations have brought to the world. This is something that we as consumers must rally around. We must demand that any information shared with a provider of any service such as these we consent only to being used to our benefit if we choose but any tracking of our movements is an infringement on our right to privacy and our thoughts and conversations are by right intellectual property and should be protected as such.
Therefore, we as Americans must demand that our use of modern conveniences and as stated before in some cases not always by choice cannot and will not be used to track anyone without their consent or without a warrant in a court of law where both sides have an advocate. This would nullify the FISA courts which are unconstitutional since it is ex parte, there is a prosecutor without a defense lawyer or even an impartial advocate. It is a one-sided presentation which has been shown can be manipulated through the willful avoiding of disculpatory evidence by the prosecutor.
The American people must insist that this tracking of our movements is by its very nature our individual property. Law enforcement agencies do not have the right to track any citizen for any reason without a warrant which was the focus of this case. Therefore this decision pointed out a fatal flaw for anyone with a cell phone, the wireless and wi-fi providers track our every movement with a date and time stamp and save it for 5 years. The time is unreasonably long and records of our movement are by nature our reasonable expectation of individual privacy and rightful property.
We need to have privacy agreements for cell phone, tablets, computer, websites, apps and wi-fi companies to clearly state that the records of our movements remain our individual property as we consent to the use of their cell towers to use their products and services. The time of record retention is arbitrary and too long. I believe that there is no reason for those records to be maintained in the manner that they are for any length of time. The mere carrying of some devices crucial to Americans does not mean I or you willfully surrender our rights to the expectation of privacy and allow our movements to be monitored and owned by anyone but the individual.
This decision did not place any limitation on government agencies nor does it involve them in the solution. I don’t seek government legislation, regulation or adjudication to solve this dilemma. We the American people who pay for our internet, cell phones and other electronic devices must demand from our government and the providers that our individual rights are not for sale and non-negotiable. The tracking, monitoring and all other intrusions on our inalienable right to privacy are intolerable and must end now. This case shows how tenuous our liberties are to a government that we clearly currently don’t own.

Inspector General Horowitz’s Report

The release of Inspector General Horowitz’s report on the actions taken at the highest levels of the Department of Justice, the FBI and even involving Presidents Clinton and Obama reveals the sheer magnitude of the problem. The fact that the 568 pages reveal an undeniable trend of bias and corruption with a minimum of five FBI agents being investigated currently should raise concerns among all Americans. We expect our government to respect our inalienable rights to life, liberty and the pursuit of happiness not to continue to interfere with and obstruct the people’s business. This investigation recounts how the FBI and DOJ working through the FISA court for the first time in American history spied on the campaign of the opposition presidential nominee.
The report is ironic in its airing of the facts and coming to a conclusion that there is nothing really to it. It shows the administration in collusion with the FBI and the DOJ planning to undermine and overthrow by whatever means necessary President Trump. The report opens the door to an end to the Mueller investigation when it calls FBI Director Comey insubordinate and deserving of dismissal since that is what directly led to the Special Counsel being appointed. This justifies the President firing the FBI Director dismissing obstruction of justice since his termination was warranted by his own misdeeds.
It also opens the door to Comey being investigated for his role in the handling of the Trump memos. The leaking of which Comey admits not only facilitating but initiating in order to spur the appointment of the Special Counsel. This speaks to criminal acts being perpetrated by Comey with the motive of continuing the effort to undermine the administration from completing its agenda. This is nothing short of aa attempted coup reversing the will of the people who by right voted for the head of the executive branch of the government, the president.
This sounds like treason but worse yet is the American people have watched this trampling of the liberties of the president and his associates and see it only through a political prism. The majority of Americans either defend or feel angered by the abuse of power by the FBI and the Department of Justice. How can we watch these illegal activities and not realize that if we allow it to happen to anybody then it can and could be happening to some of us? Especially if this can be done to the President of the United States then what can they do to us? Ask the family of LaVoy Finicum, he lost his life, murdered by FBI agents and yet justice is nowhere to be found.
We must see this for what it is an attack upon the very liberty of the American people. We are watching an alarmingly growing police state prey upon Americans with an unforeseen arrogance. They are clearly demonstrating that the wheels of power are not directed by the rightful will of the American people but someone or something else. This should be a clarion call to all liberty loving patriots that our own government is not actually our own unless we fight to reclaim it.
The federal government has grown too large and must be cut down to size. There are far too many bureaucrats eating away at our liberty and actively working to destroy our way of life. The unbridled growth of our national debt is a testament to the establishment politically powerful selling out the American people for their own gain. They must be stopped and held accountable for their crimes.
Let it truly be said that no one is above the law. That we the people rallied together, put aside our differences and realized that this is not a game, a TV show or a movie. This is an attack on our collective individual liberty and we as a people must clearly say with one voice that this will not stand. Those that we see in our federal government along with those in the shadows doing the bidding of the would-be tyrants must be held to pay for their crimes against the people of America and indeed all of Humanity.
The Horowitz report clearly states the problems at the highest level of our federal government in collusion with our law enforcement and intelligence agencies. It completely not only delegitimizes James Comey but Robert Mueller and many high-ranking officials at the DOJ and the FBI. It shows that both the Clinton email investigation and the Russian collusion investigations were not only mishandled but clearly driven by a political agenda; extinguishing the flame of liberty in favor of tyranny. Yet ironically Horowitz acts as Comey did and concludes there was no evidence of political bias.
Let the American people read the report and come to our own conclusions after all we are the true masters of this land and woe be to anyone who dares to try and strip us of our liberty and our rights. We must see this clearly through the perspective of preserving our liberties for ourselves and our posterity. If we fail to do so then all who have fought and died for our liberties since our very founding would have died in vain. With faith in Divine Providence we must act with courage and rid our land of the evil of tyranny and let liberty and freedom flourish again. It is this generation’s destiny to restore our land and our government to the rightful rulers, us!

 

The Quiet War

Boston Massacre

Unfortunately, it seems it must always be patriot blood that is spilled first for we do not seek to fight but fight we will for liberty. March 5th, 1770 British soldiers fired on a crowd in Boston killing 5 as history will tell. The victims of the Boston Massacre helped spark a revolution at the time of their deaths. But do you know the names of those who fed the Tree of Liberty with their sacrifice? You may wonder why I ask? It’s because we’ve lost men like Lavoy Finicum and many other patriots and innocents at the hand of “our government” over the years yet it remains silenced by the media as if the war being waged against the American people wasn’t happening at all.
The victims in 1770 were Samuel Gray, James Caldwell, Crispus Attucks followed by Samuel Maverick a few hours later then an innocent, Patrick Carr died two weeks later and their funerals were powerful moments uniting the people against the forces of tyranny. The irony of the timing of the murder of patriots and innocents on the anniversary of The Boston Massacre is not lost on us because history was purposely repeated 248 years later in New Jersey. The forces of tyranny brazenly murdered an innocent woman and a good man who had seen his brothers killed in combat fighting for the government he sacrificed for and betrayed him. Sending their lackeys to kill her and subdue him and hide their role in their deaths through treachery and deception.
We’ve had our version of the Battle of Bunker Hill at the standoff in Bunkerville where patriots stood ready to defend liberty but this time the government was intimidated and withdrew without a shot being fired. They later imprisoned many who were there, some like the Bundys were freed by the power of a jury of their peers, others still languish held as political prisoners in the land of the free. How many abuses must we suffer until we become outraged and can remain silent, quiet and calm no longer? The media ability we have with 24/7 coverage instantaneously worldwide hides the acts of tyranny and treason when in 1770 word of mouth and the printed press rightfully spurred the people to rebellion.
People of America the heirs to liberty bequeathed by our forefathers must find it in our hearts to cherish liberty and fight for it if we must. Justice must be served and many must be held accountable for their actions against the people they swore to protect and defend. The agents and group of globalist tyrants must be purged from OUR government and the liberty of the people must be restored. They rob us not only of our inalienable rights but our hard-earned wealth as well and those enemies of the American people must also be held to account for their crimes and repay what they have stolen.
We will never disarm and never back down. We will not be the generation that allows the flame of liberty to be extinguished. We must come together as Americans united and powerful. Diverse yet one people united by our common heritage and responsibility to secure the blessings of liberty to ourselves and our posterity. The Tree of Liberty must be watered because the forces of tyranny grow stronger and their abuses cannot be tolerated any longer so that liberty may never perish from the face of the Earth.

The Media Propaganda On The Gun Control Debate

The media in collusion with the deep state controlled government is now exploiting children to further their narrative. They demand that the president ban assault weapons and limit the size of magazines available to the law abiding citizens of this country. This supposedly would end school shootings. They say and rightly so that never again should a child die because we have the power to stop it. The truth is that we do have the power to stop children from dying at school but the solution has nothing to do with gun control. Unfortunately the globalists use these tragedies for propaganda purposes. They will be manipulated and used as a tactic to sway the people to willingly give up their liberty. This last school shooting both the FBI and local law enforcement made a series of choices allowing this tragedy to unfold yet where is the outrage about that?

People need to understand that the grief of these children, their parents, families and communities needs to be allowed to run its course not chart our country’s path. The media showcases these people to give their narrative of gun control a platform while exploiting these children to manipulate our emotions. Liberty must always be considered to be of paramount importance especially in matters of security and should never be handled by an emotional response. Ironically these people who demonize the president and the police would actually argue that the president should take away gun ownership rights because the police should have superior firepower to the ordinary citizen. How does that make any sense when the police have been demonized as racist killers and in this case clearly did nothing to prevent it?

The truth is the solution is to engineer the hazard out by controlling access into the school to secure points, fortifying the classroom doors and windows so they are impenetrable. An automated security system locking the doors tied to the local police department would control the situation until the police can arrive. The immediate aftermath of the September 11th hijacking led to the fortification of the cockpit door in commercial airliners and frankly that should have been enough but it wasn’t the end. Why do you think the passage of the Patriot Act which was an assault on our liberties went unquestioned? It was because the globalists were counting on the emotional response of the American people to rally around our government.

The media propaganda cries for gun control, that we must destroy the NRA and all of its supporters blaming evil gun owners and supporters of our inalienable rights to self defense. It is a strategy of demonization, division and ultimately a tyrannical plot to control us. We must not be fooled but instead if we want to make a difference we should secure our schools and hold our law enforcement agencies accountable.  In this last shooting the inaction of law enforcement was inexcusable. Warnings were ignored at several layers of law enforcement that could have prevented this tragedy. The final outrage is that trained and armed officers stayed outside with shots being fired in a school refusing to enter and engage the assailant while teachers and children were dying. So given these facts the logical conclusion is to disarm the people and let the government protect us? That is absurd and in a vacuum devoid of emotion even a child could tell you that.

The State of the Union

Trump State of The Union

We just heard the State of the Union speech by the President to define the state our country is in, the strides that have been made and the vision moving forward. The President said “The state of our union is strong because the American people are strong” and he is right. However I think the state of our union is under siege and the releasing of the memo about the FBI and the DOJ using the unconstitutional FISA courts to spy on American citizens needs to be released. The truth goes much deeper than anyone will admit but it’s time for the American people to awaken and reclaim our stolen liberties.

The fact that we are all under constant surveillance a brazen theft of our inalienable right to privacy is outrageous and those who do it must be held to account for their crimes. Those who aided and abetted these operations are also guilty and how high does that list go. The globalist anti-American traitors are powerful and well positioned but they work in the shadows and that’s because the light exposes truths that are undeniable when seen clearly in the light of day. This is why our very institutions are in fear because they are about to be revealed for what they are and the dominoes will inevitably fall.

This problem needs to be cleaned from top to bottom with those who felt themselves superior, tyrants, their enablers to their lackeys who try to rob us all of our individual inalienable right to pursue happiness as we see fit. Liberty can only flourish when government is small and accountable to the people who are their rightful masters. The truth is that many need to be purged from this monstrosity to cut it down to the proper size and scope in our lives. America must look to the example of Calvin Coolidge who cut the government by two thirds and spurred prosperity not only for financial gain this time but to restore something more precious, our individual liberty.

It is only when the righteous stand patriotically against a government and its agencies that threaten us yet don’t take it so well when people stand up and don’t cower in fear. Good people are being targeted and some have been jailed and even killed for simply speaking up and standing their ground which we hold sacred as Americans. Can this be the moment when the tides and currents of history change? Will America look back to our roots and our foundations and find the intestinal fortitude to fight to secure the blessings of liberty for ourselves and our posterity?

The draining of the swamp will not be easy or cheap as the tyrants will fight to preserve their places and their plans. Yet as George Washington hoped if the people retain their cherishing of liberty then only good things and happiness can be our destiny. This is the time and the place for this generation to face the challenge and ensure that liberty may not perish from the face of this Earth. That is our task, our sacred honor to uphold our inalienable right to liberty and self governance and defeat the globalist tyrants once and for all.

The Inalienable Rights To Freedom of Speech, To bear Arms and Privacy

Although we have many more rights than these, the globalist tyrants must eradicate these to rob us of our inalienable right to liberty to spread tyranny in America. The right to free speech is under attack. The internet controls the narrative by choosing what to distribute and what to censor. This is occurring as Google, Facebook and Twitter have a stranglehold on the sharing of information and all have clearly established practices to promote globalist views while stopping the spread of information on our founding principles of liberty and values on which this country was established.

The importance of the right to bear arms is eloquently described by Benjamin Franklin when he said, “Democracy is two wolves and a lamb voting on what to have for lunch. Liberty is a well-armed lamb contesting the vote!” clearly stating the right to bear arms is essential to protecting liberty. The 20th century chronicles many examples of where gun control led to disarmament of the populace and to the murders of millions repeatedly across the planet. This illustrates that liberty can only be maintained as long as the right to bear arms is not infringed.

The right to privacy is crucial in stopping the rise of tyranny and this generation preserving the rights endowed us by our Creator for ourselves and our posterity .We have endured the loss of privacy when we travel, monitored in our homes and in all our communications what are we left with? We are trading liberty for a false sense of security and in the end we are losing both. Liberty is the foundation of freedom and true security.

We willingly give up privacy using technology for convenience allowing the globalist tyrants in our government to watch, listen and track every moment of our lives. This coupled with their ability to manipulate all of these technologies creates the ability to fabricate evidence and vulnerability to false accusations. Only the right to a trial by a jury of our peers can protect us from the loss of life and liberty. This was recently on display in the dismissal of all charges against the Bundys.

Therefore we must find ways to control the narrative in America to cherishing and protecting our liberties. Repealing the immoral, illegal and unconstitutional powers this government has stolen to control free speech, privacy and gun control. We must regain control of our education system which has been hijacked to erase and rewrite history. We must hold the media accountable for distributing misinformation and reclaim the narrative. We must fight to retain and retake our loss rights to bear arms across America. We must retake our lost rights to privacy in the name of security so that liberty may endure. Finally we need to realize the truth that the most dangerous enemies to our republic are within our government working to destroy the American experiment of self governance and liberty and justice for all.
